General Terms and Conditions
The general rental conditions form an integral part of the rental agreement. Upon signing, the renter confirms that they have read these Terms and Conditions and unconditionally accept them.
1. Services and prices
The rental price is based on the valid price list and must be paid by the renter when picking up the vehicle. The rental is considered as the calendar day from 9:00 a.m. to 6:00 p.m. Time deviations must be agreed separately. The place of performance is Westerfeldstrasse 33, 8272 Ermatingen.
2. Vehicle takeover
2.1 Vehicle takeover
The renter takes over the rental vehicle in a safe and clean condition. The renter is obliged to check the rental vehicle for visible damage before starting the trip. Complaints on the part of the renter must be reported when the vehicle is handed over. The renter must identify themselves with an official document (identity card, passport, GA, driver's license).
2.2 Vehicle use
The renter undertakes to comply with the road traffic law and to use the rental vehicle and any accessories properly and carefully. Driving a rental vehicle in a state of reduced responsiveness, caused in particular by alcohol, medication, drugs, fatigue or illness, is not permitted. The renter is responsible for all damage resulting from negligence or improper use of the rental property, either to the property itself or to third-party property.
The rental properties are equipped with a bicycle lock. The renter is responsible for securing the rental vehicle and is liable for the loss of the rental property, the equipment and the key. In the case of theft, the key must be provided as proof. Removable displays on e-bikes must be removed when leaving the rental vehicle. Displays must always be replaced by the renter in the amount of the current spare parts price, if they are not returned.
The renter is liable for damage to the rental vehicle at the usual workshop prices. The rental property may not be passed on to third parties. If the renter hands over the rental property to third parties, the renter is liable for any damage caused to the rental property by third parties. The lessor assumes no liability for damage resulting from a breakdown or for dirty clothing. In any case, accidents and falls resulting in property damage must be reported to the lessor immediately. If persons are injured and/or material damage occurs to third parties or if a third party is involved as a possible (co-)cause, the police must be called in immediately, and an accident report must be completed. A copy of this must be sent to the lessor.
2.3 Vehicle return
The renter is obliged to return the rental vehicle before the end of the rental period. The vehicle and all accessories additionally rented or provided by the lessor, such as chargers, keys, bicycle helmets, etc. must be returned to the lessor in full and in perfect condition when the vehicle is returned. Loss or damage will be charged to the renter.
3. Extension of the rental period
An extension of the rental period is only possible after consultation. In the event of late return in accordance with the rental agreement or any contract extension, the renter undertakes to pay twice the daily rate per day started. If the rental property has not been returned 24 hours after the agreed date, the lessor will file a criminal complaint with the police. 4. Minimum age of the renter
4.1 General minimum age
Children and adolescents under the age of 16 must be accompanied by an adult. Children and adolescents under the age of 16 who are not accompanied by an adult may only rent bicycles with the written consent of their parents or guardian.
4.2 Legal provisions for e-bikes
By law, the minimum age for riders of an e-bike with assistance up to a maximum of 25 km/h is 16 years. (Art. 5 para. 2 letter d VZV and Art. 6 para. 1 lit. f VZV). Between the ages of 14 and 16, a category M driver's license is required (Art. 3 para. 3 VZV).
5. Cancellation / Termination
Up to 48 hours before the start of the rental period, a confirmed reservation can be cancelled or adjusted free of charge. (indicis.ch@gmail.com)
Bookings canceled less than 48 hours before the start of the rental will be charged at 100% in accordance with the applicable rates. In the event of termination of the rental period, there is no entitlement to reimbursement of the unused remaining rental period.
6. Final provisions
6.1 Liability of the lessor
The lessor assumes no responsibility and excludes any liability for damage suffered by the renter as a result of the execution of this contract, unless intent or gross negligence can be proven to the lessor. The liability of the lessor for indirect damage, consequential damage, third-party damage and lost profit is generally excluded.
6.2 Liability of the renter
The renter is primarily liable according to the provisions contained in these terms and conditions, and subsidiarily according to legal regulations, if the rental vehicle is damaged, not returned properly, stolen, or if they have violated their obligations under the terms and conditions. The liability of the renter also extends to the incidental damage costs such as expert costs, repair costs or loss of use. The renter is liable for theft or loss. The vehicle must always be secured. The loss will be charged to the renter at the replacement value.
6.3 Insurance
The insurance (accident and property & personal liability) is the responsibility of the customer.
6.4 Applicable law and place of jurisdiction
This contract shall be subject to Swiss law. The exclusive place of jurisdiction is Ermatingen (Canton of Thurgau).
